About clearing a record in Arkansas

Arkansas law lets you ask a court to seal an arrest record, a dismissed case, a misdemeanor, or some felonies under Ark. Code §§ 16-90-1401 to 16-90-1419. You file one form, the uniform petition. The clerk cannot charge a fee to file it.

If the prosecutor does not object, the court can rule without a hearing. Most misdemeanors can be sealed once your sentence is done and your costs are paid. Some felonies can be sealed right away. Others wait five years.

If the court says no, you can file again. For most misdemeanors you wait 90 days. For felonies and some listed offenses you wait one year.
