About clearing a record in Georgia

Georgia law lets you ask to restrict access to some arrest records under O.C.G.A. § 35-3-37. The record stays on file. But most background checks will not show it.

If your arrest was before July 1, 2013, you apply at the agency that arrested you. It sends your request to the prosecutor. If your arrest was on or after July 1, 2013, you contact the prosecutor's office directly.

The prosecutor decides, not a judge. If the answer is no, you can appeal to the county's superior court within 30 days.

Some arrests are restricted with no request at all. That happens when the state is never told the case went to a prosecutor, and two, four or seven years pass, based on the offense.
