Clear your Hawaii record.

You can clear your Hawaii record in certain circumstances. Hawaii law lets you petition to expunge arrest records and select first-time drug, property, or DUI sentencing records under Haw. Rev. Stat. § 706-622.5, Haw. Rev. Stat. § 706-622.8, and Haw. Rev. Stat. § 706-622.9. The process uses a petition filed with the Hawaii Criminal Justice Data Center. Hawaii enacted SB2706 in 2024, which may expand eligibility starting in 2027.

Hawaii does not create an arrest record that can be expunged if you were only issued a citation or summons and not arrested or booked for a criminal offense.

Hawaii applies specific waiting periods to non-conviction arrests that resulted from particular types of dismissals.

Petitions are filed with the Hawaii Criminal Justice Data Center rather than with the court that handled the original case.
