About clearing a record in Washington

Washington law lets a court vacate a conviction. Once it is vacated, you may say you were never convicted of that crime.

A court can vacate some felony convictions under RCW 9.94A.640. It can vacate some misdemeanor and gross misdemeanor convictions under RCW 9.96.060. You ask the court that sentenced you. The judge decides.

An arrest with no conviction is its own path. The agency that holds that record can delete it when you ask, under WAC 446-16-025. The Criminal Records Privacy Act, RCW Chapter 10.97, sets the rules.
