Expeal Application — Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the Expeal application at app.expeal.com (the "Application"). By creating an account or using the Application, you agree to these Terms. If you do not agree, do not use the Application.

In these Terms, "Expeal," "we," "us," and "our" refer to Expeal, Inc. "You" and "your" refer to the person using the Application.

These Terms apply to the Application only. Our informational website at expeal.com (the "Site") has its own Terms of Service and Privacy Policy.

2. What Expeal is — and is not

Expeal is a legal technology service provider. The Application provides information and software: it guides you through structured questions about your criminal record, assesses whether you appear to qualify for expungement or sealing under Florida law, and prepares personalized legal documents based on your answers.

Expeal is not a law firm and is not a lawyer-referral service. Despite having attorneys on our staff, information you share with us is not protected by the attorney-client privilege or the work-product privilege, and your use of the Application does not create an attorney-client relationship with Expeal or any of our personnel. Nothing in the Application is legal advice. For advice about your specific situation, consult a licensed attorney.

An eligibility result produced by the Application is an assessment based on the answers you provide, not a legal determination. Whether a court grants an expungement or sealing is decided by the court and the agencies involved, not by Expeal. There is no guaranteed outcome, whether you use the Application, hire an attorney, or proceed on your own.

3. Eligibility to use the Application

You must be at least 18 years old to use the Application. By using the Application, you represent that you are 18 or older and that the information you provide about yourself is your own or information you are legally authorized to provide.

4. Your account

The Application uses passwordless sign-in: we email a one-time passcode to the email address you register. You agree to:

  • Provide an accurate email address you control and keep it current;
  • Keep your email account secure — anyone with access to your mailbox can access your Expeal account; and
  • Notify us at security@expeal.com if you believe your account has been accessed without your authorization.

We may suspend or terminate your account as described in Section 13.

5. The service

The Application collects your answers through guided workflows, assesses your apparent eligibility for record expungement or sealing under Florida law, and generates legal documents for your review. Our staff review submitted applications and may contact you about your case using the email address on your account.

The accuracy of everything the Application produces depends on the accuracy and completeness of your answers. Laws also change, and your situation may involve facts the workflow does not capture. Before filing anything with a court, review every document carefully and consider having a licensed attorney review it.

6. Your answers and sworn documents

Documents the Application generates may include sworn statements — affidavits you will sign under oath, in some cases before a notary. Those statements are built from the answers you provide. You agree to:

  • Answer truthfully, accurately, and completely;
  • Review every generated document before signing it; and
  • Not sign or file a document containing statements you know to be false.

Making a false statement in a sworn document can be a crime under Florida law and can cause a court to deny or reverse your expungement or sealing. Expeal is not responsible for consequences of inaccurate or incomplete answers you provide.

7. Fees and payments

Where the Application offers a paid product, the price and any product-specific terms — including any refund or guarantee terms — are presented at the point of purchase. A contract for a paid product is formed at that point of purchase and is governed by these Terms and those product-specific terms. Payments are processed by our payment processor (Stripe); we do not store your full card number.

If no purchase step is presented to you, the services you are using are currently provided without charge, and no payment obligation arises.

8. Prohibited conduct

You agree not to:

  • Provide false information about your identity or submit another person's information without legal authority to do so;
  • Attempt to access another user's account or data, or any non-public part of the Application;
  • Circumvent any access control, rate limit, or security measure, except good-faith security research conducted under our Vulnerability Disclosure Policy;
  • Interfere with the Application's operation, inject malicious code, or use the Application to distribute malware;
  • Scrape or harvest data from the Application; or
  • Use the Application to violate the law or the rights of any person.

We may suspend or terminate your access if we believe in good faith that you have violated this section.

9. Intellectual property; your documents

The Application, its design, its source code, its workflows, and its document templates are the property of Expeal or our licensors. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable license to use the Application.

Documents generated for you are yours to use for your own legal matter — including filing them with courts and agencies and sharing them with an attorney. The underlying templates remain ours.

10. Feedback

If you send us a suggestion, correction, or other feedback about the Application, you grant us a worldwide, perpetual, royalty-free, non-exclusive license to use that feedback to improve our services. You are not owed compensation for feedback.

11. Disclaimers of warranty

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, EXPEAL DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, EXPEAL MAKES NO WARRANTY THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT ANY ELIGIBILITY ASSESSMENT IS CORRECT; OR THAT ANY COURT OR AGENCY WILL ACCEPT ANY GENERATED DOCUMENT OR GRANT ANY RELIEF.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply to the fullest extent permitted.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EXPEAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APPLICATION, EVEN IF EXPEAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, EXPEAL'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APPLICATION SHALL NOT EXCEED THE GREATER OF (i) ONE HUNDRED U.S. DOLLARS ($100) OR (ii) THE TOTAL AMOUNT, IF ANY, YOU HAVE PAID EXPEAL IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not limit liability for (a) fraud or intentional misrepresentation, (b) gross negligence or willful misconduct, (c) death or personal injury caused by our negligence, or (d) any liability that cannot be limited or excluded under applicable law.

13. Termination

You may stop using the Application at any time and may request deletion of your account as described in our Application Privacy Policy. We may suspend or terminate your access at any time for a good-faith belief that you have violated these Terms, with notice where practicable. Sections that by their nature should survive termination (including Sections 2, 6, and 9 through 17) survive.

14. Changes to these Terms

We may update these Terms from time to time. If we make a substantive change, we will update the "Last updated" date and notify you — by a notice in the Application, by email to your account address, or both — at least 30 days before the change takes effect where reasonably practicable. Your continued use of the Application after a change takes effect constitutes acceptance of the updated Terms.

15. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Application will be resolved exclusively in the state or federal courts located in Florida. We have not adopted mandatory arbitration; you retain the right to bring a claim in court, including an individual claim in a court of competent small-claims jurisdiction.

16. Privacy

Our collection, use, and handling of your information in the Application are described in the Expeal Application Privacy Policy. By using the Application, you acknowledge that policy.

17. Miscellaneous

Entire agreement. These Terms, together with the Application Privacy Policy and any product-specific terms presented at purchase, constitute the entire agreement between you and Expeal concerning the Application. Severability, waiver, assignment, no-third-party-beneficiary, independent-relationship, and force-majeure provisions apply as stated in the Site Terms of Service, and are incorporated here with "Application" in place of "Site."
